San Sebastián (Donostia) se rige por la normativa de la Diputación Foral de Gipuzkoa en materia de Impuesto de Sucesiones. Los herederos de los grupos I y II disfrutan de una exención prácticamente total, con un tipo residual mínimo.

El derecho civil vasco (Ley 5/2015) también aplica en Gipuzkoa, con particularidades en materia de legítima y sucesión. La legítima es de un tercio del caudal para los descendientes.
