How much does a notary cost in Spain in 2026?
Notary fees in Spain are not freely set. They are fixed by Royal Decree 1426/1989 of 17 November, which approves the notarial fee schedule. All notaries charge the same for the same type of document. There is no price competition: the difference lies in the service, speed and attention.
The schedule is structured by document type (deeds, notarial acts, certifications) and within each type, the price depends on the financial value of the transaction. A property sale of €200,000 does not cost the same as one for €50,000.
How notary fees are calculated
The fee schedule works in brackets. For deeds involving a financial amount (property sales, mortgages, donations, inheritances), the 2026 brackets are:
- Up to €6,010.12: 4.5‰ (four point five per thousand).
- From €6,010.13 to €30,050.61: 1.50‰.
- From €30,050.62 to €60,101.21: 1.00‰.
- From €60,101.22 to €150,253.03: 0.50‰.
- From €150,253.04 to €601,012.10: 0.30‰.
- From €601,012.11 upwards: 0.20‰.
A base fee of €30.05 is added for the first €6,010.12. Then 21% VAT applies on top.
Real price examples in 2026
Property purchase for €200,000. The notary fee comes to around €300-350 before VAT. With VAT, between €363 and €423. Add authorised copies (an extra €30-60 depending on pages).
Mortgage deed for €150,000. Since Law 5/2019 on real estate credit contracts, the bank pays the notary fees for the mortgage. The cost to the bank is around €250-300.
Open will. The fee is fixed: approximately €40 before VAT. With VAT, about €48. One of the cheapest notarial acts.
General power of attorney. Between €40 and €60 before VAT, depending on the length of the document.
Inheritance deed. Depends on the value of the inherited assets. For an inheritance of €300,000, the fee is around €400-500 before VAT.
Setting up an SL with €3,000 share capital. Around €150 in fees, plus €50-80 for copies. With VAT, about €240 in total.
Documents without a financial value
Documents without a financial value (affidavits, notoriety acts, powers of attorney, wills) have fixed rates set out in the same schedule. They range from €30 to €90 before VAT, depending on complexity and length.
Additional costs on top of the notary fee
The notary invoice includes, in addition to the fee:
- Authorised and simple copies: charged per page. An authorised copy costs about €3 per page; a simple copy, around €0.60.
- VAT (21%): applied to the fee and copies.
- Disbursements (suplidos): expenses the notary advances on your behalf (land registry fees, certificates). No additional VAT.
When a notary gives you a quote, ask for a breakdown of fee, copies, VAT and disbursements separately.
Can you negotiate the price?
No. Fees are fixed by law. No notary can charge more or less than established in Royal Decree 1426/1989. What varies is the number of copies requested and disbursements.
There are legal fee reductions:
- State-subsidised housing (VPO): 25% reduction in the fee.
- Mortgage subrogation: 75% reduction on the rights for the new deed.
- Grouping or splitting of plots: specific reductions in the schedule.
Online notary: does the price change?
No. Online or video conference processing does not alter the notary fee. The notary applies the same rates because they are set by law. The difference is that you do not need to travel: the meeting, document reading and signing are done by video conference with a qualified electronic signature.

Who pays the notary costs?
It depends on the type of transaction:
- Property sale: by custom, the buyer pays for the first copy and the seller pays for the original deed. Negotiable between parties.
- Mortgage: since Law 5/2019, the bank pays the notary, registry and stamp duty. The buyer only pays for their copy.
- Inheritance: heirs pay, generally in proportion to their inheritance share.
- Will: the person making the will pays.
- Donation: custom and law vary by region, but normally the donee pays.
How to reduce your total notary bill
You cannot reduce the fee, but you can reduce variable items:
Request only the copies you need. One authorised copy for the registry and one simple copy for your records is usually enough. Each additional copy adds €3 per page.
Bundle transactions when possible. If you are making a will and a power of attorney, doing both in the same appointment can reduce disbursements and travel costs.
Ask about reductions. If your property is state-subsidised or you are subrogating a mortgage, you are entitled to a reduction and the notary must apply it automatically.
