NIE for buying property in Spain as a foreigner

If you are thinking about buying a flat, a house or any property in Spain and you do not hold Spanish nationality, the first thing you need is an NIE. Without this number you cannot sign the deed of sale before a notary, pay the taxes associated with the transaction, or register the property in your name at the Land Registry.

Why the NIE is mandatory in property purchases

The notary who authorises the public deed of sale is obliged to identify all parties for tax purposes. For Spanish citizens, that identification is the DNI. For foreigners, it is the NIE. Without an NIE, the notary cannot authorise the deed. It is that simple.

In addition, the Tax Agency needs your NIE to process the Transfer Tax (ITP) or VAT, as applicable. The Land Registry needs it to register the property in your name. And the bank needs it if you are applying for a mortgage.

The deadline problem: earnest money vs NIE

This is where many foreign buyers hit a bottleneck. You have found the property you want, the seller asks you to sign an earnest money contract with a 30 to 60-day deadline to complete the deed, and it turns out you do not have an NIE.

Applying for the NIE in person in Spain requires an appointment, which in high-demand cities (Madrid, Barcelona, Malaga, Alicante) may take weeks to become available. If you opt for the Spanish consulate in your country, the process can take between 3 and 6 weeks.

If the earnest money deadline expires before you can complete the deed, you lose the deposit (typically 10% of the price). This risk is real and affects foreign buyers every month.

How to get the NIE quickly for a property purchase

The fastest route when a transaction is underway with deadlines: grant a power of attorney to a representative in Spain to process the NIE on your behalf.

The process works like this:

1. You sign the power of attorney by video conference with Notaría Online. The power is formalised in 2-3 working days.

2. The representative requests an appointment and submits the documentation at the foreigners' office: form EX-15, your passport (certified copy), proof of payment of fee 790 code 012 (9.84 euros) and the earnest money contract as proof of the reason.

3. You receive your NIE within 1 to 3 weeks. The representative sends you the original certificate by post.

While the NIE is being processed, you can sign the earnest money contract with your passport. The NIE is strictly necessary only at the time of the notarial deed.

Taxes that apply when buying as a foreigner

Buying a property in Spain entails these taxes, whether you are a resident or not:

Second-hand property: Transfer Tax (ITP). The rate varies by autonomous community: between 6% (Madrid) and 11% (Catalonia for higher brackets). Paid by the buyer.

New-build (from a developer): VAT at 10% (4% for subsidised housing) plus Stamp Duty (AJD), between 0.5% and 2% depending on the community.

3% withholding from the non-resident seller: if the seller is not tax-resident in Spain, you as the buyer are obliged to withhold 3% of the purchase price and pay it to the Tax Agency using form 211. This is a guarantee for the payment of IRNR (Non-Resident Income Tax) on the seller's capital gain. If you do not make this withholding, you will be held jointly liable for the seller's tax debt.

Annual IRNR if you do not reside in Spain: as a non-resident property owner, you must file an annual IRNR return (form 210). The tax base is 1.1% of the revised cadastral value (or 2% if not revised), at a rate of 19% for EU residents or 24% for the rest.
