Notaría Online (The Dolan Gil Company SL, tax ID (NIF) B72519374) is a technical intermediary that coordinates your procedure with registered notaries; it is not a notary's office. This policy, together with the Terms and Conditions and the service agreement you accept before payment, governs cancellations and refunds. Given the legal and personalised nature of the services, a specific policy applies in accordance with the Ley General para la Defensa de los Consumidores y Usuarios (General Law for the Defence of Consumers and Users, Royal Legislative Decree 1/2007) and, for consumers resident in the EU, Regulation (EC) 593/2008 (Rome I).
1. What this policy covers
It applies to the management fees charged by Notaría Online for coordinating and processing your service. In most cases the price of the service will include a maximum amount that roughly covers the notary's official fee (arancel). It does not cover fees and payments to third parties (Land Registry, Tax Agency, apostille, sworn translation, courier), which are governed by the rules of each body.
2. Right of withdrawal and its loss
As a consumer you have 14 calendar days from contracting to withdraw (art. 102 of the LGDCU). However, before payment you expressly accept the immediate start of the service and acknowledge that, once it has begun, you lose the right of withdrawal (art. 103.a). Nor does the right apply to personalised or made-to-measure documents, such as drafting a power of attorney, a notarial record (acta) or a deed with your details (art. 103.c), or to services already fully performed.
3. Cancellation requested by the client
You may cancel the service only before the document review or the coordination with the notary's office begins. Once the file has been opened (verification of identity or documents, contact with the notary's office, booking of an appointment or preparation of the draft), no cancellation or refund is available, except as provided in point 6. In exceptional situations, if the cancellation takes place after the file has been opened, a retention of between 20% and 50% of the management fees may be applied, depending on the work already done.
4. Client cooperation and deadlines
To carry out the procedure, you must provide the requested documents within 48 to 72 working hours of contracting. Failure to meet this deadline may lead to the automatic cancellation of the file, with no right to a refund, in accordance with the service agreement.
5. Services already performed
Once the notary has begun their involvement (preparation of the draft, identity validation or booking of an appointment), the service is deemed performed for contractual purposes. No refund is available in these cases:
- If you decide not to continue with the procedure.
- If the notary, in their legal judgement, refuses to authorise the signature because legal requirements are not met or because of the appearing party's lack of capacity.
- If there are technical or operational failures on your part.
6. Impossibility attributable to Notaría Online
If we cannot provide the service for internal reasons attributable to our organisation (technical error, lack of coordination or unjustified unavailability) and there has not yet been any involvement by the notary or validation on your part, we will refund the full amount paid.
7. Additional services not performed
If the file is cancelled or interrupted before the notarial signature, additional services not yet started may be refunded, such as the Hague apostille, courier delivery or translations and legalisations not yet requested from third parties. These partial refunds must be requested in writing and are assessed case by case.
8. Changes requested by the client
Once a draft has been delivered or validated, any subsequent substantial change (new signatories, type of document, legal content, etc.) may involve an additional cost if it was not covered by the original fee and, in some cases, the partial or full reopening of the file.
9. How to request a cancellation or refund
Send your request in writing to [email protected] stating your full name, the file number and a brief explanation of the reason. We will review the request and reply with our decision within a maximum of 14 calendar days. Refunds are paid using the same payment method you used, at no cost to you.
10. Acceptance of this policy
By contracting our services and signing the digital service agreement, you declare that you have read and understood this policy, that you expressly accept the loss of the right of withdrawal once the service has begun, and that you understand that Notaría Online acts as a technical intermediary and not as a notary's office.
11. Complaints and dispute resolution
Complaint forms (hojas de reclamaciones) are available to you; you can request them at [email protected]. If you are a consumer, you can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
Notaría Online reserves the right to amend this policy at any time; changes will be published on this page.
