Steps to Cancel the Mortgage in the Property Registry

Having paid the last installment of your mortgage is a moment to celebrate. However, the process does not end there: the mortgage continues to appear as a charge in the Property Registry until it is formally canceled. We explain step by step how to do it.

Why is it important to cancel the mortgage in the Registry?

While the mortgage remains registered in the Property Registry, your property appears legally encumbered. This can complicate a future sale, obtaining another loan, or simply reflects a situation that is no longer real. The registry cancellation leaves the property completely free of charges.

Steps to cancel the mortgage in the registry

1. Request the certificate of zero debt from the bank

Once the mortgage is settled, you must request from your banking institution a certificate of zero debt or payment letter. This document certifies that the loan has been fully satisfied. The bank must also appoint a representative to appear before the notary.

2. Grant the deed of cancellation before a notary

3. Settle the Tax on Documented Legal Acts (AJD)

The deed of cancellation must be presented to the regional Tax Agency to settle the AJD. In most cases, mortgage cancellation is exempt from this tax, but it is mandatory to submit the corresponding form (usually the 600) with the exemption indicated.

4. Present the deed in the Property Registry

With the authorized copy of the deed and the tax presentation receipt, the cancellation is presented in the corresponding Property Registry. Within a period of 10 to 15 business days, the registrar cancels the mortgage inscription and the property is left free of charges.
