How to cancel a mortgage in the land registry in Spain

Why cancel the mortgage in the registry

Paying your last mortgage instalment does not erase the charge from the Land Registry. The bank stops collecting, but the registry still shows your property has a mortgage lien. That has practical consequences.

If you want to sell your home, the buyer (or their bank) will see the mortgage on the nota simple. The same happens if you need a new mortgage or a property guarantee. As long as the charge appears, your property is not registrally clean.

Registry cancellation is voluntary. Nobody forces you. Many people live for years with the mortgage paid off but not cancelled. But when the time comes to sell or request financing, it has to be done in a hurry, and haste costs money or causes delays.

The bank's payoff letter

The first step is to obtain the carta de pago (also called a zero-balance certificate). This is the document where the bank declares that you have repaid the entire mortgage debt.

The bank is obliged to hand it over. Normally it is issued within a few days of the final repayment. If they do not do it automatically, request it in writing. If they delay more than a month, you can complain to the bank's Customer Service and then to the Bank of Spain.

The payoff letter is free of charge by law (Article 7 of Law 2/1994 on subrogation and modification of mortgage loans, applied by analogy).

The cancellation deed before a notary

With the payoff letter, the next step is to execute the public deed of mortgage cancellation. In this deed, an authorised representative of the bank appears before a notary, declares the debt paid in full and consents to the cancellation of the mortgage in the registry.

The person who signs on behalf of the bank is normally a representative with sufficient power for cancellations. You, as the property owner, do not need to attend. Only the bank needs to sign.

The notary fee for a cancellation deed ranges from €90 to €200, depending on the capital secured by the mortgage. For a mortgage with €150,000 in capital, the notary fee is around €120-150. VAT (21%) and copy costs are added on top.

In practice, the total cost of the deed with copies usually falls between €150 and €250.

Filing at the Land Registry

Once the deed is signed, it must be filed at the Land Registry where the property is recorded. The registrar reviews the document and, if everything is correct, cancels the mortgage entry.

The registry fees for a mortgage cancellation are fixed: €24. This is the same amount regardless of the mortgage capital.

The registration period is 15 working days from filing. In practice, many registries resolve it in 5-10 days.

Can you cancel the mortgage without a deed?

Yes. Cancellation by lapse exists. Article 82.5 of the Mortgage Law allows the mortgage to be cancelled without a deed when 20 years have passed since the maturity of the guaranteed obligation (normally the date of the last instalment per the original deed) plus 1 additional year. That is, 21 years after the mortgage matures according to its original deed.

In that case, a private application from the registered owner is enough, without the bank needing to appear. The registrar checks that the deadlines have been met and cancels.

For most people, waiting 21 years is not practical. If you want to sell or remortgage, you need the cancellation deed.

Cancellation costs: summary

  • Bank payoff letter: free.
  • Notarial cancellation deed: €90-200 fee + VAT + copies. Total with VAT: €150-250.
  • Land Registry: €24.
  • Agency (if you delegate the process): €150-300 extra.
  • Stamp duty (AJD): exempt. Mortgage cancellation does not pay AJD since the reform under Law 5/2019.

Typical total without agency: €175-275. With agency: €325-575.

Total timeline

From requesting the payoff letter to the registry cancelling the charge, the process takes between 1 and 2 months. Typical breakdown:

  • Bank payoff letter: 1-2 weeks.
  • Cancellation deed: 1-2 weeks (depends on the bank representative's availability).
  • Registry filing: 1-3 weeks.

If you are in a hurry to sell, notify the bank from the start and ask them to expedite the deed.

Who pays for the cancellation?

The borrower (you). Law 5/2019 of 15 March, regulating real estate credit contracts, assigned the bank the costs of formalising the mortgage, but the registry cancellation is borne by the property owner.

If you are selling and the buyer wants the property free of charges, you normally pay for the cancellation before the sale. It is your expense as the seller.
