A foreign buyer signs the deed of purchase and sale before a notary. The next question is always the same: when will I have the TIE? The real times usually exceed initial expectations. This article explains the current average timeframes, the necessary documentation, and the specific actions that can be taken right after signing to avoid penalties for irregular stay.

The TIE After the Notarial Signing

The TIE is the physical card that certifies the identity and legal status of non-EU foreigners in Spain. It contains the NIE, the photograph, and the fingerprints. The notarial purchase and sale does not grant automatic residence. Many buyers begin the regularization procedure immediately after because they plan to stay longer than permitted as tourists.

Organic Law 4/2000 regulates the entry and stay of foreigners. Its implementation is found in Royal Decree 557/2011. If the 90 days of stay are exceeded in any 180-day period without authorization, it results in irregular stay. Fines range from 501 euros to 10,000 euros depending on the severity. Real Timeframes from Signing to Receiving the TIE

From the notarial signing until having the TIE in hand, an average of 110 days pass. The calculation is divided into four clear stages. The first stage is tax settlement. You have 30 business days to file form 600 and pay the Property Transfer Tax. The tax rate ranges between 6% in the Canary Islands and 11% in Valencia for used homes.

The second stage is applying for the residence authorization if you do not have it yet. The Administration has three months to decide according to Royal Decree 557/2011. In the case of residence by investment regulated in Law 14/2013, the deadline is reduced to 20 business days.

The third stage is obtaining an appointment for fingerprinting. In Madrid and Barcelona, the current average wait is 60 to 85 days. In Alicante, the average drops to 25 days and in Malaga it stands at 35 days. The fourth stage is the issuance of the card. After the appointment, the TIE is produced and is available for pickup between 15 and 30 days later.

She submitted the non-lucrative residence application on March 5. She received a favorable resolution on April 18. She requested an appointment at the Alicante Foreigners' Office the same day and was given a date for May 15. She attended the appointment, submitted the documents, and collected her TIE on June 3. In total, 112 days passed from signing until she had the card. Ana had planned her stay and avoided any days of irregularity.

These times are real averages taken from cases processed during 2023 and 2024. They vary depending on the province, the workload of each office, and whether the application is submitted in person or online with a digital certificate.

Errors That Double the Waiting Timeframes

The most common error is attending the appointment without the proof of payment of the fee. The office rejects the application and requires a new appointment. This adds between 30 and 60 additional days. Another common mistake is photographs that do not meet the exact specifications or have a shadowed background. Rejection is immediate.

Many buyers submit the old form downloaded from unofficial websites. The correct version must show the visible update date. It is also common to forget the apostille or the sworn translation of foreign documents. The file is halted until the deficiency is corrected.

Requesting the appointment in a province different from the one of registration generates automatic rejection. Changing offices after starting the file requires submitting a new application. Another mistake is not checking that the passport has sufficient validity. If it expires during the process, the entire procedure is canceled.

These errors not only delay obtaining the TIE. They also increase the risk of exceeding the 90 days of permitted stay and receiving a penalty notice. Reviewing each document twice before the appointment avoids these setbacks.

The offices with the shortest response times are located in the Valencian Community and the Region of Murcia. The Foreigners' Office in Alicante and Elche offer appointments with an average of 20 to 30 days. Murcia capital and Cartagena also maintain waits shorter than those in the major capitals.

In Andalusia, the offices in Malaga and Marbella perform better than the one in Seville. Madrid and Barcelona have the longest waiting lists, with appointments exceeding 70 days in many cases. If you have flexibility with your address, consider registering in a province with less workload.

The appointment is requested through the electronic headquarters of the Ministry of the Interior or by calling 060. Select the option «Police – TIE – Card Issuance». It is necessary to have a prior NIE or digital certificate. Some buyers hire a registered manager who submits the application online and reduces the wait.

Collect the notarial deed and request the authorized copies you will need. Verify that the parties' data and the property description are correct. On the same day or the next, start the payment of the corresponding tax. Locate a bank or submit form 600 electronically if you have a digital certificate.
