How are notary fees calculated?

Notary fees in Spain are not freely set: they are fixed by Royal Decree 1426/1989 (Notary Fee Schedule). All notaries apply the same rate, regardless of city or whether the process is in-person or online.

For documents with a monetary value (purchases, inheritances, donations, company formations), the fee is calculated using a decreasing scale applied to the total value of the transaction. The first €6,010.12 has a fixed cost of €90.15, and from there progressively lower percentages are applied to successive brackets.

Documents without a monetary value (powers of attorney, wills, prenuptial agreements, mortgage cancellations) have a fixed fee established in the same royal decree. Additional pages and certified copies are added on top.

What do the fees include?

The notary fee covers the notary's intervention: drafting and authorizing the public deed, mandatory legal advice to the parties, and custody of the notarial protocol (the original document is archived at the notary's office).

  • Taxes associated with the transaction (transfer tax, stamp duty, inheritance and gift tax)
