Is the regulatory agreement mandatory?

It is not mandatory, but it is highly recommended. Without an agreement, in case of breakup, the general rules of the Civil Code will apply, which do not recognize the de facto partnership as such and can lead to very detrimental situations for the economically more vulnerable member.
