Si vives fuera de España y necesitas dar poder a alguien para vender, heredar o firmar allí, no hace falta que viajes. Hay dos caminos y la elección cambia el plazo y el coste.

Puedes otorgar un poder válido en España sin viajar, por dos vías. La primera es firmarlo en el consulado español de tu país: el documento llega a España sin trámite adicional, porque el cónsul ejerce función notarial. La segunda es firmarlo ante un notario local y después apostillarlo; sirve porque España, México, Argentina y Colombia firman el Convenio de La Haya, pero añade la apostilla y, casi siempre, una traducción jurada. La firma por videoconferencia ante notario español existe desde la Ley 11/2023 para los poderes de un acto concreto, aunque en la práctica exige un certificado digital español que quien vive fuera rara vez tiene.

¿Consulado español o notario local con apostilla?
Las dos producen un poder que un notario y un registro españoles aceptan. Cambian el plazo, el coste y lo que tienes que hacer tú.
- Vía consulado: menos pasos
- Firmas ante el cónsul español de tu ciudad. El poder ya está en español y no necesita apostilla ni traducción. El cuello de botella es la cita: en los consulados de México DF, Buenos Aires y Bogotá suele haber semanas de espera.
- Vía notario local: más rápida de conseguir
- Firmas ante un notario o escribano de tu país. Después hay que apostillar el documento y, salvo que se firme en español, traducirlo por traductor jurado. Más pasos, pero la cita se consigue en días.
- Redacción desde España
- En las dos vías, el texto del poder lo redactamos aquí. Un poder redactado fuera con facultades genéricas es la causa más común de que el notario o el registro español lo rechacen después.
- Facultades concretas
- Si es para vender, el poder tiene que nombrar el inmueble con su dirección y referencia catastral. Si es para una herencia, las facultades de aceptar, partir y adjudicar. Lo genérico no vale.
- Apostilla, si hace falta
- Cuando firmas ante notario local, gestionamos la apostilla desde 50 € + IVA. Sin ella el documento no surte efecto en España.
- Seguimiento hasta que se usa
- El poder no termina cuando lo firmas: tiene que llegar al notario o al registro que lo va a usar en España. Nos ocupamos de esa parte.

Si firmaste ante notario local, se apostilla y se traduce si hace falta. Después el poder se pone a disposición de quien lo va a usar aquí.
¿Qué necesito para otorgar el poder desde fuera?
- Tu pasaporte o documento de identidad en vigor
- Tu NIE si lo tienes; si no lo tienes, dínoslo, porque para algunos trámites hace falta y se puede pedir en paralelo
- Nombre completo y DNI o NIE de la persona a la que das el poder
- Para qué es exactamente: vender un inmueble concreto, aceptar una herencia, operar con un banco
- Si es para vender: dirección y referencia catastral del inmueble
No hace falta que la persona apoderada esté presente cuando firmas. Basta con tener sus datos.

Los cuatro países —España incluida— firman el Convenio de La Haya, así que la apostilla basta y no hace falta legalización consular. Eso simplifica la vía del notario local: firmas, apostillas y el documento ya sirve en España.
El consulado español sigue siendo la vía con menos pasos, porque el cónsul ejerce función notarial y el poder no necesita ni apostilla ni traducción. El problema no es legal, es de agenda: conseguir cita consular puede llevar semanas, y si tienes una firma de compraventa con fecha, esa espera decide por ti.
La videoconferencia no es para todo el mundo
La Ley 11/2023 permite firmar por videoconferencia ante notario español los poderes especiales, los de un acto concreto. Es real y tiene la misma validez que la firma presencial. Pero el trámite pasa por el Portal Notarial del Ciudadano, que pide certificado digital español para identificarse, y quien vive fuera y no ha tenido residencia en España rara vez lo tiene.
Por eso, si estás fuera, casi siempre acabas en una de las dos vías de arriba. Preferimos decirlo antes que después de cobrarte.
¿Cuánto cuesta?

¿Y si el poder ya está firmado?
Si ya lo firmaste sin que nadie revisara el texto, mándanoslo antes de darlo por bueno. Un poder con facultades genéricas se rechaza en la notaría o en el registro, y rehacerlo desde fuera cuesta más que haberlo redactado bien.
¿Esto es lo mismo que un poder internacional?
No. Un poder notarial internacional se firma en España y se apostilla para usarlo fuera. Esta página es el camino contrario: se firma fuera para usarlo en España.

What is the legalization of a signature and how does it differ from a notarial power?
The legalization of signature is a notarial act distinct from the power. In the legalization, the notary certifies only that a signature is authentic and belongs to the identified person, without creating any representation or authorization. The notary does not attest to the content of the document.
The notarial power, on the other hand, authorizes a person to act on behalf of another for one or several specific legal acts.
When is signature legalization needed?
- Private documents that must be presented to organizations requiring notarial authentication
- Contracts or assignments of rights that will be used abroad
- Administrative applications that require a legalized signature
Signature legalization is faster and more economical than a public deed. It can be processed online with the signatory appearing via video call, as provided by Law 11/2023.
What types of notarial powers of attorney are there?
Notarial powers are classified according to their scope:
- General power: authorizes the attorney-in-fact to act in any matter on behalf of the principal (patrimonial, personal, judicial, etc.).
- Special power: limited to a specific act: selling a specific property, signing a specific contract, representing in a specific lawsuit.
- Power for lawsuits: to act in judicial and arbitral proceedings.
- Banking power: to operate accounts, contract financial products, etc.
- Preventive power: for the case of future incapacity of the principal (widely used in dependency planning).
- Irrevocable power: in specific cases, it cannot be revoked unilaterally.

Can a power of attorney be revoked? How?
Yes, a power of attorney can be revoked at any time by the grantor, unless it is irrevocable by agreement.
Revocation procedure:
- Grant a notarial deed of revocation before a notary
- Notify the revocation to the attorney (recommendable in a reliable manner: registered mail)
- If the power was used for registry inscription or was notified to third parties, it is also advisable to notify said third parties
Automatic extinction of the power: The power extinguishes without the need for revocation in the event of death, declaration of incapacity, or bankruptcy of the grantor or the attorney, unless it is a preventive power.
It is important to act quickly when you want to revoke a power to prevent the attorney from carrying out undesired acts before receiving the notification.
Does a notarial power of attorney signed via videoconference have the same legal value?
Yes, exactly the same legal value as a power of attorney granted in person.
The Notarial Law, reformed to allow remote notarial actions, establishes that the notary can authorize public documents by identifying the grantor via videoconference with the required technical guarantees.
The process is identical to the in-person one:
- The notary verifies the identity of the grantor through the DNI/NIE visualized by camera
- The notary reads the document in full
- The grantor gives their consent
- The notary attests to the signature and the content
The resulting document is a notarial public deed with full validity erga omnes, registrable in registers, accepted by banks, administrations, and courts.
What is a power of attorney used for in practice?
Powers of attorney are indispensable in numerous everyday situations:
- Real estate purchase and sale: when the owner cannot attend the deed signing
- Inheritance management: so that an heir can manage the process on behalf of all
