Online Notary via Video Call: How It Works and Legal Validity in Spain (Law 11/2023)

Notaría Online
·

Notarial signature via video call is now a fully legal reality in Spain thanks to the Law 11/2023, of May 8, on the digitization of notarial and registry proceedings. If you wonder if it is possible to grant a public deed without physically attending the notary office, the answer is yes: with full legal validity and the same effects as the in-person signature.

What is notarial signature via video call?

Notarial signature via video call is the process by which the notary authorizes a public document (power of attorney deed, will, donation, purchase and sale, etc.) with the grantor in any location in the world and the notary in their office. The session is conducted via videoconference with prior identification of the signer using their ID or passport.

Is signature via video call with a notary legal in Spain?

Yes, it is completely legal since the entry into force of Law 11/2023. This law amended the Notarial Law to expressly enable remote notarial proceedings via videoconference, provided that the following are guaranteed:

  • The authentic identification of the grantor
  • The full reading of the document by the notary
  • The free granting of consent
  • Notarial public faith regarding the signature and content

The resulting document is a public deed with all its effects: registrable in registries, enforceable against third parties, accepted by banks and public administrations.

How does it work step by step?

  1. Online request: You contact Online Notary, describe the procedure you need, and attach the basic documentation.
  2. Draft preparation: Our legal team drafts the document and sends it to you for review in advance.
  3. Video call appointment: On the agreed date, you connect from your computer, tablet, or mobile. The notary verifies your identity by showing your ID/NIE on camera.
  4. Signature and authorization: The notary reads the document, you confirm your consent, and the notary attests to the act.
  5. Sending of the original: The originally signed document is sent to your home via courier.

What documents can be signed via video call?

The vast majority of notarial acts can be granted via videoconference:

  • Notarial powers of attorney (special, general, preventive)
  • Wills
  • Donations
  • Purchase and sale deeds (when the seller or buyer cannot appear)
  • Corporate deeds (formation of LLC, capital increases)
  • Matrimonial agreements
  • Declarations of heirs

What do I need to sign with a notary via video call?

The technical requirements are minimal:

  • Device with camera (computer, tablet, or smartphone)
  • Microphone (built-in or headphones)
  • Stable internet connection (minimum 5 Mbps)
  • Updated browser (Chrome, Firefox, Safari, or Edge)
  • Valid ID, NIE, or passport

No application installation is necessary. Our team performs a prior technical test to ensure everything works.
